CPC 1908 Civil Procedure Code 1.3.0

The Code of Civil Procedure, 1908 is a procedural law governing civil proceedings in India. It is structured into two parts: the first part comprising 158 sections and the second part featuring the First Schedule, encompassing 51 Orders and Rules. While the sections outline general principles of jurisdiction, the Orders and Rules detail the procedures guiding civil proceedings in India.

For the sake of procedural uniformity, the Legislative Council of India enacted the Code of Civil Procedure in 1858, which received the Governor-General's assent on March 23, 1859. However, this Code did not apply to the Supreme Court in the Presidency Towns and the Presidency Small Cause Courts. Subsequently, it was replaced by the Code of Civil Procedure, 1877, which also underwent significant amendments due to evolving requirements. The Code of Civil Procedure, 1882 was introduced in 1882, but over time it became evident that further amendments were needed to enhance its efficiency and timeliness. As a response to these challenges, the Code of Civil Procedure, 1908 was enacted; despite numerous amendments, it has endured over time.
